Noctiluca Navigator (Windows / Linux) License Agreement
1. Grant of License
The Company grants you a non-exclusive, non-transferable, non-sublicensable license to use the Software free of charge, subject to the terms of this agreement. The Software is licensed, not sold.
You may install and use the Software on any number of devices for any lawful purpose, including both personal and commercial use.
2. Restrictions
You may NOT:
- (a) Sell, rent, lease, sublicense, or redistribute the Software for a fee.
- (b) Modify, adapt, or create derivative works of the Software.
- (c) Remove or alter any proprietary notices, labels, or marks in the Software.
- (d) Use the Software for any unlawful purpose or in violation of any third-party rights.
Reverse engineering, decompilation, or disassembly of the Software is prohibited, EXCEPT as expressly permitted in Section 4 of this agreement.
3. Intellectual Property
All rights, title, and interest in the Software (including but not limited to code, graphics, logos, trademarks, and documentation) remain with the Company or its licensors. This agreement does not transfer any ownership rights to you.
4. Open-Source Components and Reverse Engineering
4.1 Qt Framework (LGPL)
The Software dynamically links against the Qt framework, which is licensed under the GNU Lesser General Public License (LGPL) v3. The Qt binaries distributed with the Software are:
- On Linux: the unmodified Qt libraries provided by each distribution’s package manager.
- On Windows: the unmodified Qt binaries provided by The Qt Company.
No modifications have been made to the Qt source code or binaries for the purpose of developing this Software. The complete source code of Qt is available from The Qt Company (https://www.qt.io/) and your distribution’s package repositories, respectively.
4.2 Your Right to Replace Qt Libraries
In accordance with the LGPL, you may replace the Qt shared libraries (DLL/SO files) linked by the Software with your own builds of Qt, provided they are of a compatible version.
4.3 Limited Reverse Engineering Permission
Reverse engineering, decompilation, or disassembly of the Software is permitted solely and exclusively for the purpose of troubleshooting compatibility issues when exercising your right to replace the Qt libraries as described in Section 4.2. Any reverse engineering beyond this limited scope is strictly prohibited.
4.4 Other Open-Source Components
The Software may include other open-source components. Their respective licenses are listed in the THIRD-PARTY-NOTICES file, if applicable.
5. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE SOFTWARE.
7. Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
8. Governing Law and Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
